There are two types of Overseas Filipino Workers:
- Agency-hired, which means you apply and got accepted through a recruitment agency;
- Direct Hire, wherein a foreign employer contacted and hired you directly.
Agency-hired workers have less to worry about, especially when you applied in legitimate recruitment agencies. On the other, being hired directly can be an issue since you have to handle everything yourself.
Here’s what we know, so far, about POEA’s latest rules and guidelines on Direct Hire workers:
Ban on Direct Hiring
As of POEA’s Memorandum Circular No. 8, Series of 2018, no employer can directly hire an overseas Filipino worker for overseas employment. Still, there are organizations who are allowed to recruit Filipino workers. Those who are exempted from direct ban hiring includes:
- International organizations
- Members of the diplomatic corps
- Heads of State and government officials with at least Deputy Minister rank
Those who bear a lesser rank may be allowed IF endorsed by Philippine Overseas Labor Office (POLO) or Head of Mission in case there’s no POLO.
Other exempted individuals are:
- Professionals and skilled workers with duly executed authenticated/verified contracts, with terms above the prescribed guidelines set by POEA. The number of workers hired must not exceed five workers.
- Those who were hired (except domestic workers) by a relative or family member who is already a permanent resident in the host country.
Employment Standards as Shown in the Employment Contract
Despite being a direct hire, your foreign employer must still set forth acceptable and reasonable terms to make sure your rights are protected. In line with this, the following employment standards must be set forth in the Employment Contract, which includes the following, but not limited to:
- Compulsory life / repatriation insurance coverage
- Basic compensation package, which includes position, job location, and basic monthly salary
- Commencement and duration of the employment contract
- Employee benefits such as bonuses, food and accommodation (or their monetary equivalent), overtime pay, transportation to and from work, end of service rewards, and emergency and medical treatment among others
- Work hours and leaves (vacation and sick)
- Just or valid causes of termination
- Repatriation
POEA Requirements to Process Direct-Hire Deployment
- Pre-employment medical examination, as evidenced by Certificate of Medical Fitness
- Certificate of Attendance to Pre-Employment Orientation Seminar (PEOS) and Pre-Departure Orientation Seminar (PDOS)
- Verified or authenticated original Employment Contract, each page signed by employer or its authorized representative
- Philippine passport with at least six months validity prior to intended departure
- Valid work visa or permit
- Proof of certificate of insurance coverage
- Notarized statement of the worker as to how the employment was secured, which also includes contact details of your employer
- TESDA Skill Certification and Certificate of Attendance to Comprehensive Pre-Departure Education Program (CPDEP) for domestic workers
Procedure for Direct Hire Documentation:
Documentation of Direct Hire Workers will be managed by Direct Hire Assistance Division (DHAD) under Pre-Employment Services Office. In case your employer doesn’t fall under the exempted category, then here are the procedures you need to follow:
1. Submit requirements for documentation and evaluation. You will then be informed if your employer may be allowed to hire workers directly after the DHAD makes recommendation.
2. If allowed, a Clearance will be issued by POEA administrator.
3. Once the Clearance is granted, the following steps must be made:
- Proceed to DHAD so that the DHAD authorizing officer can approve and sign the Employment Contract.
- Fill up the OFW Info Sheet.
- Relevant information will be encoded in the Direct Hire E-Processing System
- Pay appropriate fees with POEA (processing of documents), OWWA (OFW membership), Philhealth, and PAG-IBIG. Your Overseas Employment Certificate will be issued once fees on respective government agencies are paid. Take note that the foreign employer should pay OWWA and POEA processing fees as well as visa, work permit, airfare, and insurance coverage. Membership to government agencies like SSS and Philhealth will be shouldered by you, the worker.
- Your records will be endorsed to POEA Central Records Division.
Take note that the registration of Direct Hires can be done in POEA main office and Regional Centers and Units through Regional and Overseas Coordinating Office.
I reckon that the government should not make it difficult for Filipinos to be hired directly specially by large foreign companies. I am giving example to my own experience. I used to be an agency supplied Oil Field worker and had to be content with the salary which after the agency’s cut is not even a quarter of what the company is paying to the agency. We were not also covered by the international health and sickness benefits. Not until the company was recruiting agency personnel for direct hiring and promotion and of course, the offer was beyond your wildest imagination. To make the story short, I got hired directly and climb up the ranks through completion of company sponsored training. My monthly income went as high as 15,000 USD and even got paid the same amount of salary during a month off on a Month On/Month Off rotation. My family was covered by the company’s health benefits,and I am covered by a lifetime pension plan.
To step back in time a bit, before I got hired, I have to go through a lot of scrutiny through POEA/OWWA. I have to present to them the contract I signed with the company which must be registered thru POEA. They were so concerned that I may fall into an illegal recruiter or a bogus company hence the figures were too good to be true. I got prostrated at this point because how can I get my company to go through all these hassles, they might just drop me off instead. Eventually, it was sufficed with a certification from my new employer and a direct fax from my company HR in the US. I presented to them my Insurance and health benefits which is a thousand folds better than the local standards.I also have to present my membership in a company Stock options which is a dream if I were an agency hire. To sum it up, I was employed by the largest Oil Drilling Company for 25 years and just recently retired. My children went through prestigious schools and earned their degrees. We managed to build and expand our family business and still have enough to look forward to for the years to come.
The bottom line is…how come the government have to the right to ban Direct Hiring and be selective whom to be hired? I reckon that the government should encourage foreign companies to directly hire Filipinos for better future rather than limiting their opportunities.

Unfortunately and as harsh as it sounds, this is government policy and there’s nothing we can do but to abide by these rules. Surely, there are sound reasons behind this. Nonetheless, we’re happy to read that life overseas worked well for you.
I think these is not the righf thing that you ban direct hired especially in a good country,actaully the government give oppurtunities to agency that can get more money for those people who want ta have a work outside the country .please if you do this kind of rule not only for ofw you must have rule also for agency that they cant put high price on there service.dont put ofw for suffer alot that these things only..you must select the country that need to ban direct hire like kuwait saudi the middle east country why have alot of ofw there can go more faster that country you must to focus and must strict that countries..

Hi Nara. Direct hired workers are not totally banned. The government now requires more documents to be submitted to avoid possible cases of human trafficking. We understand that this could be hassle, but surely, the government has a reason why this was imposed.

Hello Kaye. As per POEA Memorandum Circular, the limit is five for companies hiring Filipino workers for the first time. We’re not sure if this applied to companies who had previously hired Filipino workers.
Ms Lara, I just want to ask a question. Three of my friends were confronted with the same dilemma right now.
They came to South Africa a few months back on a visit visa with business related condition for six months. When their visa expired they went back to the Philippines but the company wants to hire them back directly.
They have acquired all the necessary documents and the employer is more than gracious to provide them with everything that the POEA has ask.
Now, when it comes to the Authorization letter for the exemption of direct hiring ban, they reached a dead end because we don’t have POLO here South Africa. And the embassy representative said that they cannot issue such documents because they have no labour authority to do so. So what is the remedy to this? What would be their next course of action? The authorization letter is the only thing missing in their list.
Hi Joie. If there is no POLO, the Philippine Embassy or Consulate may issue the said requirement as per POEA rules.
What do you mean not totally banning the direct hire? A friend did a direct hire for Singapore helper, she processed all Singapore permits and OWWA but helper cannot be issued OEC in Singapore as she is a direct hire and a first timer in SG. When my friend processed her OEC in Phils, she’s asked to go through an agency as direct hire is not allowed. Agencies do not know what to do since her Singapore permits are already done. I am in the same situation. We are so confused how to move forward with our helpers OEC.
Hello Vivian! Direct hire workers will ahve to go thru stricter requirements. There is a separate division in POEA who handles that. As long as all documents are complete, workers will be given OEC. Same experience here bro although not as high as your salary. I’m here at the airport at the moment and just been offloaded by immigration because they wont believe me. Largest mining company in the world is trying to hire me but they might drop me off because of all this bullshit requirements. I strongly agree, ginagawa nilang pahirapan ang processing. We do understand na it’s a government policy they can bend the rules naman e, for example yung OEC,nakikiusap na to follow nalang kasi ipapadala naman the following day, di ka padin eendorse for PDOS kahit almost complete na ang requirements at OEC nalang wala. Dahil sa processes nagdadalawang isip ang ibang employers to employ Filipinos just because of the process. Waste of time din kasi and resources e.

Hi Rolando! Skipping POEA, OWWA, PDOS is illegal. These agencies as well as attending PDOS are mandatory. There is a possibility that it might be scam so it is best to stay away from that so-called sponsor.

My working Visa is on process and handled by a lawfirm and needed my presence for verification and finalisation of my working visa application at Naturalisation Immigration Service Netherlands. Do I still need to comply requirements for OWWA AND POEA?

Hi Ambot. Ideally, no since that would be unfair on those directly hired prior to the ban. Upon expiration of contract, that’s the time when you have to apply through licensed recruitment agencies.

She told me that employer urgently needed a worker and if im interested to proceed my order Full Package Application so they can inform the employer. Before to proceed i need to pay 27 + 18 euro via paypal or debit as the processing fee of my papers. Hi Jomar! Did you check the legitimacy of the recruitment firm? Do you know the name of the company where you will be assigned? It’s hard to judge but to be safe, you need to inform the firm about the requirements for Direct Hires and see if they are amenable to that.

I was able to get a Job in Malaysia. Since POEA banned direct hirin abroad, this company went through one of the recruitment agencies here in the Philippines. It is clearly stated in my contract that I was hired for a managerial job (Bank Company) . However, the visa given by the recruitment agency stated that I’am employed as a Cleaner? Would this be an issue?

Hi, you may contact POLO USA to process your OEC before going home to the Philippines. As long as you’re in US, they’ll be able to help you. OEC is only valid for 60days though, so this is advisable for OFWs who are only planning to stay in the PH for less than 2months.
I’m bound to US and still here in the PH, i thought POLO USA could help me with OEC processing. They advised me to coordinate with POEA because I’m out of their jurisdiction since I’m currently in the PH.

I am a graduate school student in Tokyo, Japan and doing job hunting just like a regular student in Japan would do. I got my written job acceptance notification in one company and can start this November. I currently have a student visa and can be easily switched to a working visa if the necessary requirements are submitted to the Japanese Immigration Bureau. Can I go through this POEA/OWWA process while I am in Japan?
It seems as if this regulation would require students with a Philippine passport studying abroad to go back to the Philippines and go through the OWWA/POEA system which seems impractical and costly for both the employers and employees. Honestly, I am already in Japan and quite stable already in terms of finance and housing. Going back to the Philippines just to do this would revoke my job acceptance which I have worked hard for in months.

I would suggest that you coordinate with POLO Tokyo. You may ask their assistance in obtaining your OEC. I believe they can process it since you’re in Japan. POEA only processes OEC, if you’re coming from the Philippines.

They will just update your details in the site and will let you pay for processing fee. after that they will print out the OEC and that is it.

Anyone who can help me here? I submitted my documents August 17,2018 for evaluation. It has reached the 2nd signatory on August 23, Thursday. I was out for Medical Exam for whole day on Friday so I wasn’t able to get an update yesterday.
I was supposed to fly to the US on August 15, after learning about the process, I requested my employer to rebook my flight. They rebooked my flight on September 2 (Sunday).
I’m really stressed out with the signatories. I’m still waiting for the original contract tho. My employer mailed them out to me Thursday and said I should expect 1-3 days shipping.
I only have to go through PDOS to acquire my OEC. But it’s crunch time for me since Monday is declared holiday. I only have 4 days in total to process my OEC. Is there any way that I can expedite the process? 😭

Hi Janice! Will your relative hire you? If yes, exempted naman po kayo sa direct hire ban. Still, you need to undergo medical exam, PEOS, and PDOS among others. Baka po yung amoung na sinabi ng agency is for their processing fees; hence ganun kamahal since medyo complicated po kapag direct hire.

Hi Kenneth! Working overseas means you will have to convert your status as OFW. You can course through your employment through a recruitment agency na magpa-process ng iyong application. This would mean that your employer must coordinate with the agency as well.

How long does this process take? I have been asked to do this and is just starting with POEA. I have all the necessary requirements passed and the OIC in POEA said she will have to evaluate my contract and other documents, etc. Can I possible know how long does this take?

I was directly hired in Myanmar thru the referral of my brother who’s also working with the same employer. I’ve already processed all the required documents of POEA for OEC only to find out that they couldn’t release me an OEC and required me to go thru its accredited agency. And so I inquired on the referred agency but I was told that agency’s license is still about to be released by POEA so they cant help me process my OEC on my target deadline which is Nov. 18.
How can I meet my target deadline? My employer told me that he will cancel our arrangement if I cant get there on the target date.
Hi Jerna! Apologies but direct hire is banned by POEA. If you were hired directly, then kailangan po talaga that you go through an agency na makakatulong mag-process ng inyong documents. You can still push through as Direct Hire worker, but you need to comply with the requirements indicated in this post. I’m afraid that if you do, you won’t be able to meet the Nov. 18 deadline. I’m sorry but we cannot help you anymore on this.

POEA Direct Hire is totally tricky. I and my one colleague apply for professional and skilled workers that included in other exempted from direct ban hiring , even you give all the necessary documents on their requirements list they still asking other documents yun tipong lahat na authenticated letter from DFA, DOLE, POLO,Embassy nakuha mo na then they still pushing us to go thru an agency(just weird). For this matter I advise that you must depend all the documents you had and have a full blast supporting documents to prove. Pabalik balik na lang kami dun sa bansa na pupuntahan under business or tourist trip pero yun application naming for OEC para maging formal yun working visa na nakatatak at approve sa amin passport ,eh kaso pending pa din for approval sa POEA direct hire assistance ng ilang buwan na,LOL#justsharing#patienceismust

Hi, I have a bit of a problem. I looked for a job in Japan as a Software Engineer and found a company. We’ve finalized everything and accepted a job offer from them. Here comes the problem. Obviously, I’m a direct hire as I found this company myself, went through interviews and such and accepted an offer directly with them. By the time we have to process my documents for visa sponsorship, they were advised that we have to go through an agency for the processing of my documents in POEA. So far everything’s done and all but now the agency is asking me for a placement fee. Which I think is wrong because placement fee is for the fact that they PLACED you in that job. Where they connected you to the employer etc. Like when you applied through the agency and got the job through them, right? But that’s not the case for me. So do I have a choice not to pay them the placement fee? Or since they’re the ones who processed my documents in POEA means I have to pay them? Can I just cancel all that and try to process on my own? I’m qualified as a skilled worker being in the engineering/IT field.
Hi Kim! POEA will advise you to go through agency since sila na po mag-process ng documents mo to legitimize your status overseas. Perhaps, you can negotiate the fees since hindi naman totally sila ang nakahanap ng employer.
Hi Kim, If you took the the PEOS Certification online, it was indicated that the recruitment agencies are prohibited to ask for placement fees if you are going to certain countries. The list includes Japan, UK, USA (H2B), etc

Submit material list: (provide scanned first)
1. Certificate of work qualifications (full time work certificate):
Certificates of work experience, including position, issued by the unit where the applicant had previously worked, relating to the work of the current employment post.
Work hours or projects that have been done should be signed by the applicant’s original work unit with the official seal or the person in charge, and the applicant should have a valid contact telephone or e-mail.
2. The highest degree (academic degree) certificate or relevant approval document, professional qualification certificate.
If the highest degree (diploma) certificate is obtained abroad, it shall be certified by my embassy or consulate abroad or by the embassy or consulate of the country in which the applicant has obtained the degree (diploma) or by the certification institution of the diploma certification in China.
3. No criminal record.
It shall be issued by the police, security and court departments of the applicant’s nationality or habitual residence and certified by our embassy or consulate abroad or by the foreign embassy or consulate in China. The issuing time is within 6 months.
4. Physical examination certificate
Certificates of verification of physical examination records or certificates of health examination for foreigners issued by China’s inspection and quarantine organs or certificates of physical examination issued by overseas medical institutions approved by China’s inspection and quarantine organs shall be issued within six months.
5. Applicant’s passport or international travel document
The valid period of passport is not less than 6 months.
6. The applicant has a positive bareheaded photo within 6 months.

Just wanna ask po, I was direct hired from Oman to QataR Last Dec 17,2017 as Sushi chef in a Japanese restaurant.then i gave my resignation on Nov 23,2018 and my last day is Dec. 17, 2018. on Dec. 15 i was told by the manager I am terminated and that no need to go on duty anymore the company has no more enough funds to pay for the staffs. I went to polo and labor to file a complaint against the company since we had delayed salary for than a month and 8 months overtime still wasn’t paid, and settlement until now was not yet given. AMD first and second invitation for hearing and settlement in Labor, the employer didn’t showed up. On third invitation the PRO showed up but still my settlement wasn’t given.then yhe polo told us to come back on sunday for the settlement. My question is, do I have the rights to get all my unpaid overtime, my vacation pay,gratuity and 1 month salary even though I am direct hired? Please response. thank uou

Hi! I would like to ask is there a special requirement that kuwait has for medical examination? My friend was diagnosed for having a scar on her x-ray but not a transferrable/infectious disease. The clinic reject her and gave her unfit to work. We already had a second opinion from an intellicare clinic and she was diagnosed normal. No scar at all. We went back to the said clinic and showed the result and was advised to wait for another result for the comparison of their doctor. What shall we do if they still give the same verdict? HI Marivic. Required po ang OEC before kayo umalis ng Pilipinas, otherwise, baka po ma-offload kayo. This is a mandatory requirement po since it shows that you are a legitimate OFW. Pwede naman po kahit walang agency as long as lahat po ng requirements na nakalista ay masu-submit ninyo. Salamat.

Therefore, I will just tell my employer to hire any employee other than a Filipino or else they have to deal with the consequences:
1. Pay hefty fees to the agencies or
2. Suffer the difficulty of complying to the direct hire requirements.

Hi JR. Why would your employer not want to give you a copy of the contract? Unfair naman po ata yan since dapat, mayroon kayong contract na napirmahan bago po kayo umalis papuntang SG. Hindi po talaga papayag si POEA without presenting verified employment contract.

I’m a direct hire under IT field way back 2013, does it mean that I am affected by the ban on direct hire?
According to the exemption:
“Professionals and skilled workers with duly executed/authenticated contracts
containing terms and conditions over and above the standards set by the
POEA. The number of professional and skilled Overseas Filipino Workers hired
for the first time by the employer shall not exceed five (5). For the purpose of
determining the number, workers hired as a group shall be counted as one;”
Does it mean that if my contract is above the standards I can process my own papers without going through an agency?

HI Jocel. It’s hard to “judge” based on this information alone. Have you checked the company? Where is it based? What kind of work will you render? Sino ang recruitment agency na magprocess ng inyong documents sa POEA? Who will shoulder the fees? These are some of the things you need to look into para malaman kung legit or scam lamang po ito.

I was hired in an IT company in Dubai. I was referred by a friend. Now the problem is the company already exceeded 5 Filipino. But from the memorandum, it says The number of professional and skilled workers hired by the employer FOR THE FIRST TIME must not exceed 5. Meaning I am still exempted from processing through an agency. Tama ba? This is not their first time hiring Filipino. Although most of the Pinoy there were hired when they were already in Dubai. If everything goes well, I will be the very first to come from the Philippines directly. Right now I am waiting for the POLO verified contract be shipped to me before I can go to POEA and process this bullshit (OEC). From what I read, why is POEA insist of getting an agency when you are a professional/skilled worker and already have the documents they need to be exempted from the ban? Is this agency a legitimate scammer? If so, then we wouldn’t need this Direct Hire Department since they will just ask us to go and get an agency to process your paper. Well, I will still try my luck dealing with these scammer (POEA). If it didn’t go well, I’ll ask my employer to book a ticket going Dubai from somewhere and I’ll go there as tourist. Just so I can leave this country hassle free. From my research, processing OEC in POLO Dubai is as simple as ABC.
Hi Marbsz. The worker has an option to go through an agency who could help process the documents or proceed directly to Direct Hire Division. Getting OEC in POLO Dubai could be risky but as long as you presented sufficient documentation, they’ll issue the OEC naman.

Nag undergone na rin po kasi ako ng medical kasi one of the requirements po iyon ng Canada bago ako mabigyan ng working visa. Hello po. May kumuha po kasi samin ng friend ko as a caregiver sa California. Nakilala ko po sya through may cousin. Hinigan nya po kasi kami ng 3000USD each for visa processing na magtatagal daw po for 6 months. Binigyan nya po kami ng options kung san ipapadala yung pera. Pinili ko po maghulog na lang ng pera through bank account dito sa pinas since sabi nya mas mahal pag usd kasi bibili pa ng dollar tapos may charge pa pag sinend sa kanya. Currently working din po sya sa california and 14yrs na syang resident dun. May sinend po sya samin nung nakaraan na photo ng binayad nya at acknowledgement letter from the lawyer na nag aasikaso ng working visa namin. Possible po ba na scam ito? Sabi nya po kasi na ibabalik nya yung money kung hindi maapprove yung visa. Pero wala pa naman daw po nangyari na nadeny ang working visa. Please someone help me po. Thanks in advance.

Hi Jamie. The police clearance could be for formality nalang po. As long as your worker completed all the requirements, then wala naman po magiging problema sa pag-exit sa Pilipinas.

I tried to response to them and accomplished Application Form and Online Interview Questionnaire. After two(2) days, they emailed me that I passed the online interview and got the job. They informed me also regarding the terms and conditions.
On May 15, they sent me the job offer & acknowledgement letter. It is really a great offer!!! I will not
placing any money except for the personal bond (Php13,160) for the work permit. And it is refundable after the contract with the company. The company will pay for my Visa/Work Permit fees together with flight and accommodation.
Then last week, I submitted reqts for the Employment Pass / Working Permit. Then yesterday, they sent me Approval of Employment Pass in Malaysia from immigration. And asked me to pay the Bond immediately until today morning.
I just want to ensure if the offered job at “United Construction Bhd” is legal or not before anything else.

Hi Ivy. Have you checked the legitimacy of the company? Perhaps, you could ask assistance from the Malaysian Embassy to help you verify the company. You also need to inform them regarding our requirements since POEA is strict when it comes to direct hire.

The validity of my OEC (balik manggagawa) is last March only. A school in China hired me and the contract will start in August. Hi Jules. If different employer, then you might be required to go through the process for direct hire. You will be asked to submit documents (enumerated on this post) to verify your status as OFW.

Hi Rodel. You can go to POLO in Hong Kong so they could issue you Overseas Employment Certificate. Make sure you have original / certified employment documents with you when you apply for OEC.
Hello. Just want to ask if direct hire ang isang agency ok lng na hindi sila registered sa POEA? may nag offer po sa akin work as DH sa dubai. I can search them in google and also mayroon FB page wherein mababasa ko po mga remarks and other information pati photos po ng agency mismo ay meron.

Kapag ayaw namin sa employer pwede bumalik sa agency and change employer. Same din kapag ayaw ng employer sa amin. Ibabalik kami sa agency.

Hi Rose. Looks like there are red flags there. A legitimate recruitment agency MUST be registered sa POEA. Kahit direct hiring, dapat dumadaan parin sa POEA. Also, hindi pwede na visit or tourist visa ang ibibigay sayo because kung may legitimate na trabaho, dapat WORKING visa. Huwag po tayo nagpapaniwala agad sa nakikita sa Facebook page. If you could share the name, much better po para maiwasan na mabiktima ang ibang mga kababayan natin.

we are supposed to wait for our work visa as per agency after completion of required docs for direct hire applicants, weeks passed agency informed us that our employer dropped as out despite of the signed job offer letter. if this is legal, are we entittled for a refund or lumpsum on the expenses of securing pertinent papers and damages from previous jobs that we left?

Hi Hanzo. Looks like there are lots of red flags here. For starters, they should give you a working visa and NOT tourist visa. Also, you should be asked to sign an employment contract here at hindi sa Dubai. Maaari po kayong harangin sa Immigration dahil hindi legal ang pag-alis ninyo sa bansa at baka po ma-offload kayo.

Hello Darwin. Yes, OEC is required since this will serve as proof that you are a legit OFW. You get exemption on airport fees and travel tax as well.

Also, my brother recently received a direct hire offer from a manufacturing company in Saudi Arabia for a Furniture Designer position. They have couriered him the Original signed Employment Contract with all his comp/benefits stipulated on it as per labor law requirements, his original Work Permit/Employment Visa, Copy of Company’s Business License/Commercial Registration and Owner’s ID and contact details. Hi Malou. You can submit original copy of your employment contract sa POLO so they can have it verified. Present your passport and work visa as well. This way, male-legitimize ang inyong status as OFW and they will issue you OEC.
How long it will take for this process?
Hi Malou. This depends. As long as you submitted all the documents, the agency could release your OEC in two days time, then attend PDOS, and you’re good to go 🙂

We have submitted the all the original requirements through the POEA authorized agency (Androme Recruitment Agency) and they have submitted to the POEA already, how long will it take before we receive a status from POEA? My brother is a direct hire in Australia and was advised by his employer that if he is still struggling with the proceasing of papers here in the Our BELOVED COUNTRY PHILIPPINES then maybe they will consider hiring them next season considering that everything are already ready except for this ORC and PDOS things which is to be done after your very GOOD OFFICE has done the necessary and very slow review process. We really don’t know why it is very slow like a snail or we need to pay you under the table for the fast processing. Do you have a standard time of proceasing for these kind of application? I wanted to write an open letter to the president regarding these issues, I am really dissappointed that even employears abroad were so dissappointed with how our government process things!! It is like a snail! Hope to receive your response on this and is there any means to expedite the process? Or it will take months before we can get feedback from your good office?

As much as we would like to help you on this matter, we are not well-versed as to the process and only get our information based on what the POEA post on their website. Have you checked with the POEA or the agency already? We notice that the POEA issues OEC after one or two days upon submission of requirements.

Unfortunately, we were not able to proceed because we learned about the limit of 5 direct hires per employer (they already have 7 OFWs on record when I checked with POEA), and my employer was not willing to go through an agency. 🙁 It really crushed my hopes of working abroad!
I’m just wondering if there has been any update on the limit of direct hire OFWs? Also, what are other legal options if I don’t go through an agency?
Hi Cho. Sorry to hear about this. Unfortunately, the limit is still at 5. Anything in excess would mean POEA will require you to go through an agency.

Hi Christine, sa POLO, just present your new and original Employment Contract, as well as passport and work visa. POLO must validate and authenticate your contract po para mapalitan ang inyong employer.

2016 ako umalis sa Taiwan. Then kinontak ako recently for an offer to work from them again, Kapag balik sa same employer at same location, at may old oec na din, need pa ba magprocess sa simula? Or thru bmonline na lang ung processing?
You may get an exemption through the BM Online System. Please make sure na complete lahat ng employment documents para hindi po magkaproblema.

Hi Alvin. The limit is five for direct hires so the remaining two have to go thru an agency. Hindi naman po siguro made-deny as long as complete ang requirements and legitimate ang job overseas.
What to do if I’m a direct hire and employer has hired more than 5 filipinos throughout its operation? Company is a very big australian company operating more than 50 years. Surely there can be something done to be given exemption on ban on direct hiring.
Hi Joy. The government limits it to five lang po. The rest must have to go thru an agency (I think the POEA could recommend an agency for that) for the processing of documents.

Hi Joce. Is the job offer legit as well? If your potential employer is willing to give all the required documents and send it here in the Philippines so you can submit sa POEA, then much better. Otherwise, asking for your passport first sounds dubious already.

I already have working visa and the contract signing is supposed to be done in Japan so I’m not sure how will I be able to apply for EOC for now since wala ako copy ng contract pa. Hi Tish. Ideally, you must submit all the requirements so they could issue an OEC. Do you have work visa already? Can you request for a certified true copy of the employment contract from your employer?

Hello! We’re not sure regarding this but there should be an approved job order first. Please coordinate with the agency as well since they will be the ones processing and finalizing your work and travel documents.

Hi! Your friend needs to get an OEC from POLO. Pls submit the working visa, original certificate of employment or employment contract, and passport so your friend can get an OEC.

Hi, I would like to directly hire my niece to be caregiver to my husband as he is now suffering dementia. As my niece has taken good care of my mom in the Philippines until she died at ripe age of 92, I would really prefer her to come to Canada rather than hiring somebody local that I do not know. She will be applying through the Pilot Caregiver Program. Is this exempt from the ban on direct hiring?

I am returning OFW from my previous company but of different country location. I used to work at Corporate Office in Taiwan but will now be relocated on China operation from the same company.
I am a direct hire and would like to process my OEC. I went to POEA main office this morning but was held by the premise guard as I do not have an appointment. I told the guard that I am securing an OEC as direct hired OFW and there was no instruction nor guidance on POEA website and related blogs that requires prior appointment for OEC application specific to my case. The POEA staff stationed outside the building instructed me send an email to certain dhad_lbc@yahoo.com and request for an appointment.
Please confirm authenticity of requiring prior appointment in securing OEC for direct hire. If indeed a requirement I would suggest for POEA to update the guidance accordingly for future accurate reference.

Hello! Direct hire means wala ng agency. Still, kailangan niyo parin dumaan sa POEA thru Direct Hire Division at isubmit ang lahat ng documents na hinihingi upang ma-issue ang inyong OEC.

Hello! As long as you have necessary documents, then that could be possible. You also need to coordinate with POLO in Saudi so they can authenticate your employment contract and to prove that there is a job waiting for you in Poland.
